Victoria Edwards is a skilled general business and litigation attorney with over 15 years of experience litigating for and advising large banking and financial institutions, insurance/oil & gas/mining companies, construction companies, and various small businesses on complex business matters, including contract formation and interpretation, and novel bankruptcy issues.
Most recently, Ms. Edwards litigated mortgage loan servicing and lending issues for major financial institutions concerning the Truth in Lending Act, the Real Estate Settlement Procedures Act, the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, state fair lending laws, and collection and deceptive trade practice laws. While at Akerman LLP (a top 100 law firm according to the National Law Journal NLJ 350), Ms. Edwards was recognized as the first female homegrown partner of Akerman’s National Consumer Finance Litigation & Compliance Practice Group. In this leadership position, she successfully defended mortgage loan servicers, investors, and originators in class actions, individual lawsuits, and bankruptcy adversary cases at the motion to dismiss and summary judgment stages.
While at Akerman, Ms. Edwards also presented oral argument in the United States Court of Appeals for the Ninth and Tenth Circuits and the Colorado Court of Appeals on critical issues governing the mortgage servicing industry. For example, she successfully moved to dismiss three putative class action lawsuits concerning loan modification issues and unfair business practices against large banking and financial servicing institutions. See, e.g., Yau v. Deutsche Bank Nat. Trust Co. Americas, 2011 WL 5402393 (C.D. Cal. Nov. 8, 2011) (Selna, J.), affirmed in part, reversed in part sub nom by Yau v. Deutsche Bank Nat. Trust Co. Americas, 525 Fed. App’x 606, 607 (9th Cir. 2013); Haney v. Aurora Loan Services, 8:2014cv00002 (C.D. Cal. 2014) (Guilford, J.); Newhouse v. Aurora Bank FSB, 915 F. Supp. 2d, 1159, 1166 (E.D. Cal. 2013).
In addition, Ms. Edwards obtained a favorable ruling for the foreclosure industry in Colorado when the Tenth Circuit affirmed the legality of Colorado’s foreclosure laws in McDonald v. OneWest Bank, F.S.B., 680 F.3d 1264 (10th Cir. 2012) and Mbaku v. Bank of Am., Nat’l Ass’n, No. 14-1379 (10th Cir. June 15, 2015).
In the Ninth Circuit, Ms. Edwards also obtained a favorable decision, affirming a California federal district court ruling in a wrongful foreclosure case. The Court found no unfair business practices and no breach of the covenant of good faith and fair dealing or any implied or express contract concerning the modification of a borrower’s mortgage loan after the expiration of an in-house workout agreement. See Nguyen v. Aurora Loan Servs., No. 13-55737 (9th Cir. June 15, 2015).
With this substantial litigation experience in the highest courts in the region, Ms. Edwards now works with small businesses and entrepreneurs to anticipate potential issues with their business matters, as well as to initiate and manage commercial and civil liability disputes, such as contracts, commercial law matters, breach of contract and business torts, and unfair competition/unfair business practices/defamation issues.
Ms. Edwards is admitted to practice law in the state courts of Colorado, California, New York, and New Jersey. She is also admitted to practice in the United States District Court for the District of New Jersey, the Southern and Eastern Districts of New York, the District of Colorado, the United States Bankruptcy Court for the District of Colorado, all of the District Courts and Bankruptcy Courts of California, and the United States Court of Appeals for the Eighth, Ninth, and Tenth Circuits.

Victoria recently worked on a personal matter of mine. This is how I would summarize her attributes: Professionalism Though I thought that my case may be considered "simple" (response to Cease and Desist letter), Victoria assuaged my suspicions but also at the same time, explained the bigger implications my case would have if not addressed correctly. This particular opposing party was being very aggressive, and Victoria did not feel as if compliance to their "request" would be satisfactory to them. She proved herself to be thorough but efficient in her analysis of the case and the opposing party. (i.e. not logging tons of billable hours). When it came time for action, Victoria was very prompt and would even provide updates past outside normal working hours, to include weekends. She countered the opposing parties claims, issued a "Demand letter," and essentially put the aggressive party on the defense. (My wife and I describe her actions being like, "a pitbull attacking a junkyard tire." Her bite is definitely worse than her bark.) My wife and I are very happy with the results. Victoria was able to amend the Sheriff's police report, address the opposing party's claims, and position us as such that if another incidence arise, that we would be in an easily defensible position and most likely would be able to demonstrate that the opposing party is justifiably wrong. Personality One aspect of the case that I enjoying thoroughly was actually speaking with Victoria. She is very personable and gives an impression of being genuinely interested in our situation. I felt as if she truly owned the case as if she was the one being "attacked" and that she wasn't just an agent hired by us to help. As a matter of fact, at some points she offered to figuratively bury the opposing party by suggesting she could depose them, ask for their evidence, file a restraining order, etc. We had to pull her back as we wanted to resolve the situation to the point of having the parties go their separate ways, not having them submit to our position/"cry uncle." She followed our lead/request, but still let the opposing counsel know that she would have preferred it if we let her hammer his clients. Her personality was great on the case. She really was in our corner and made us feel comfortable. Costs Honestly, I don't know how she stays in business with the rates she charged us.

Victoria is awesome!! Our former landlord was trying to charge us for a complete carpet replacement and additional charges that we should have not been responsible for. After reviewing our lease and contracts, Victoria made a few phone calls and sent some very professional emails to the management company which resulted in them dropping the charges to avoid going to court. She is very knowledgeable in landlord and tennant rights and will do anything for her client. She is very passionate about what she does and it clearly shows.
